1. Terms of Use
By downloading, browsing, accessing or using this mobile application, you agree to be bound by these terms and conditions of use. We reserve the right to amend these terms and conditions at any time. If you do not agree to any of these Terms and Conditions of Use, you must immediately stop accessing the Mobile Application and using the services provided on the Mobile Application. Continued use of the Mobile Application constitutes acceptance of these Terms and Conditions of Use, as may be amended from time to time.
2. Definitions
In these Terms and Conditions of Use, the following capitalized terms shall have the following meanings, unless the context otherwise requires:
"Registration" means the creation of an account on the Mobile Application, and "Registration" refers to the act of creating such an account.
"Account" means an account created by the User as part of the registration on the Mobile Application.
"Privacy Policy" means these Terms of Use and the Privacy Policy set forth herein.
"Services" are all services provided to the User through a mobile application, and "Services" means any of them,
"User" means the user of the Mobile Application, including you, and "User" means any of them.
3. Your Obligations
3.1 Accurate Information: You warrant that all information provided upon registration and contained as part of your Account is true, complete and accurate and that you will promptly notify us of any changes to such information by updating the information in your Account.
3.2 Prohibitions on Use of the Services or Mobile Application: You undertake not to use or allow any other person to use the Services or Mobile Application:
3.2.1 Send or receive any uncivilized or tasteful material
3.2.2 send or receive any material that is threatening, seriously offensive, indecent, obscene or threatening, profane or defamatory to any person, contemptuous of court or contrary to confidentiality, copyright, moral rights, rights of publicity or privacy or any other third party rights;
3.2.3 send or receive any material for which you have not obtained all necessary licenses and/or approvals (from us or third parties); or constitute or encourage conduct that is considered a criminal offense, gives rise to civil liability, or otherwise violates the laws of any third party in any country in the world or infringes the rights of any third party;
3.2.4 send or receive any material that is technologically harmful (including computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malware or harmful data);
3.2.5 Cause annoyance, inconvenience or unnecessary anxiety;
3.2.6 intercept or attempt to intercept any communication transmitted through telecommunications systems;
3.2.7 for purposes other than the purpose for which we designed or intend to use;
3.2.8 for any fraudulent purpose;
3.2.9 except in accordance with generally accepted Internet practices and any network connection practices;
3.2.10 incite hatred against any ethnic, religious or any other minority, in any manner, or otherwise intentionally adversely affect any individual, group or entity; or in such a way, or to carry out any action that would or does impose an unreasonable or disproportionately large load on our infrastructure.
3.3 Prohibition on Use of the Services, Mobile Applications: Without limitation, you further undertake not to or permit any other person:-
3.3.1 attempt to circumvent our security or network, including accessing data that is not appropriate to you, logging into a server or account that you have not expressly authorized to access, or probing the security of other networks (such as running port scans);
3.3.2 Perform any form of network monitoring to intercept data that is not suitable;
3.3.3 extract data from or hack a mobile application;
3.3.4 use the Services or Mobile Application in violation of these Terms and Conditions of Use;
3.3.5 engage in any illegal activity related to the use of the Mobile Application or Services; or engage in any conduct which, in the Bank's reasonable opinion, restricts or inhibits any other customer's proper use or enjoyment of the Mobile Application or Services.
4. Rules regarding the use of the Services and Mobile Applications
4.1 We do not warrant that your use of the Services or Mobile Applications will be uninterrupted or that any information (or messages) transmitted through the Services or Mobile Applications will be accurate, reliable, timely or complete. Although we will endeavor to allow uninterrupted access to the Services and Mobile Applications, access to the Services and Mobile Applications may be suspended, restricted or terminated at any time.
4.2 We do not warrant that the Services and Mobile Applications are free of viruses or anything else that may have a harmful effect on any technology.
4.3 We reserve the right to change, modify, replace, suspend or delete any information or services on the Mobile Application from time to time without prior notice. Your access to the Mobile Application and/or Services may also be occasionally restricted to permit the repair, maintenance, or introduction of new facilities or services. We will attempt to restore such access as soon as reasonably possible. For the avoidance of doubt, we reserve the right to withdraw any information or services from the Mobile Application at any time.
4.4 We reserve the right to block access and/or edit or remove any material that we reasonably believe may result in a breach of these Terms and Conditions of Use.
5. Suspension and Termination
5.1 If you use (or use by anyone other than you) the Mobile Application, any of the Services in breach of these Terms and Conditions of Use, we may suspend your use of the Services and/or Mobile Application.
5.2 If we suspend the Services or Mobile Application, we may refuse to resume the Service or Mobile Application for your use until we receive your assurance in such form as we deem acceptable that there will be no further breach of these Terms and Conditions of Use.
6. Disclaimer of Warranties and Exclusion of Liability
6.1 The Mobile Application, the Services, the information on the Mobile App and the use of all related facilities are provided on an "as is, as available" basis without warranty of any kind, either express or implied.
6.2 To the maximum extent permitted by applicable law, we disclaim all representations and warranties relating to the Mobile Application and its content, including representations and warranties relating to any inaccuracies or omissions in the Mobile Application, warranties of merchantability, quality, fitness for a particular purpose, accuracy, availability, non-infringement or implied warranties of course of dealing or trade usage.
6.3 We do not warrant that the Mobile Application will always be accessible, uninterrupted, timely, secure, error-free or free of computer viruses or other intrusive or destructive code, nor that the Mobile Application will be affected by any act of God or other force majeure event, including the inability to obtain or lack necessary materials, equipment facilities, electricity or telecommunications, lack of telecommunications equipment or facilities and failure of information technology or telecommunications equipment or facilities.
6.4 While we may use reasonable endeavours to provide accurate and up-to-date information on the Mobile Application, we make no warranties or representations as to its accuracy, timeliness or completeness.
6.5 We shall not be liable for any act or omission of any third party, and for any direct, indirect, incidental, special, consequential or punitive damages, howsoever caused, caused or in connection with such damages, arising out of the Mobile Application and the services provided in the Mobile Application, your access to, use of, or inability to use the Services provided in the Mobile Application or the Services provided in the Mobile Application, reliance on or downloading from the Mobile Application and/or Services, or any delay, inaccuracy in the transmission thereof, This includes, but is not limited to, damages for loss of business or profits, use, data or other intangible assets, even if we have been advised of the possibility of such damages.
6.6 We shall not be liable in contract, tort (including negligence or breach of statutory duty) or otherwise for any indirect, consequential, incidental, special or incidental loss or damage suffered or incurred by you as a result of the Mobile Application and these Terms and Conditions of Use. For the purposes of these Terms and Conditions of Use, indirect or consequential loss or damage includes, but is not limited to, loss of revenue, profits, anticipated savings or business, loss of data or goodwill, loss of use or value of any equipment, including the Software, third party claims, and all related and incidental costs and expenses.
7. Intellectual Property
7.1 All editorial content, information, photographs, illustrations, artwork and other graphic material on the Mobile Application, as well as names, logos and trademarks, are protected by copyright laws and/or other laws and/or international treaties and belong to us and/or our suppliers, as the case may be. These works, logos, graphics, sounds or images, in whole or in part, may not be copied, reproduced, retransmitted, distributed, transmitted, sold, published, broadcast or transmitted in whole or in part, except as expressly permitted by us and/or our suppliers.
7.2 Nothing on the Mobile Application shall be construed as granting, by implication, estoppel or otherwise, any license or right to use any trademark displayed on the Mobile Application without our written permission. Misuse of any trademarks or any other content displayed on the Mobile Application is prohibited.
7.3 We will not hesitate to take legal action against any unauthorised use of our trademarks, names or symbols to assert and protect their rights in this matter. All rights not expressly granted herein are reserved. Other product and company names mentioned herein may also be trademarks of their respective owners.
8. Revisions
8.1 We may periodically change the content of the Mobile Application, including the description of advertised goods and services, at any time without notice. We do not accept any responsibility or liability for any errors or omissions in the content of the mobile application.
8.2 We reserve the right to amend these Terms and Conditions of Use from time to time without notice. The revised Terms and Conditions of Use will be posted on the Mobile App and will be effective from the date of posting. You are advised to review these terms and conditions periodically as they are binding on you.
9. Applicable Law and Jurisdiction
9.1 Mobile Applications may be accessed from all countries worldwide (except Chinese mainland) as local technology allows.
10.Expenses
AI Partner Plus offers free and paid services. You can learn more about the different types of AI Partner Plus subscription services here. Prices may be based on the billing information you provide to us when placing your order.
Subscriptions and Renewals. If you want to subscribe to AI Partner Plus membership, you can purchase it according to the automatic renewal method. You can cancel your subscription at any time. If you cancel your subscription, the fees already charged are non-refundable.
Tax. Unless otherwise agreed in your agreement or order with AI Partner Plus, taxes are included in your subscription fee.
Cancel your subscription. You may stop using the Services and/or unsubscribe at any time through your account settings. If you cancel your subscription, you will not be entitled to a refund of any fees already paid, and you shall pay all pending fees due early, which you shall pay immediately.
Try it for free. AI Partner Plus may offer you a free trial period. AI Partner Plus reserves the right to set eligibility requirements and duration for free trials.
Price changes. AI Partner Plus reserves the right to change prices at any time. If you're a subscriber, the changed price will take effect the next time you renew.
11. Privacy Policy
10.1 The User's access to the Mobile Application and use of the services provided on the Mobile Application are subject to this Privacy Policy. By accessing the mobile application and continuing to use the services provided, you are deemed to have accepted this Privacy Policy. We reserve the right to amend this Privacy Policy from time to time. If you do not agree to any part of this Privacy Policy, you must immediately stop accessing the Mobile Application and using the Services.
10.2 As part of the proper functioning of our Services, we collect, use and, in some cases, disclose information about you to third parties. Therefore, we have developed this Privacy Policy so that you understand how we collect, use, communicate and disclose and use your personal information when you use the Services on your mobile application:
(a) Before or at the time of collecting personal information, we will determine the purposes for which the information is collected.
(b) We will only collect and use personal information for the purposes specified by us and for other compatible purposes, unless we have the consent of the individual concerned or are required by law.
(c) We will only retain personal information for as long as necessary to achieve these purposes.
(d) We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the relevant individual.
(e) Personal information should be relevant to the purposes for which it was used and, to the extent necessary for those purposes, accurate, complete and up-to-date.
(f) We will protect personal information from loss or theft, as well as unauthorised access, disclosure, copying, use or modification through reasonable security measures.
